Cheque Bounce — The Strictest Timeline in Indian Law

The cheque bounce notice timeline under Section 138 NI Act is the most rigid sequence in Indian law. Every step has a hard deadline:

What Happens When You Miss a Time Limit?

Missing the 30-day notice deadline means the criminal complaint is not maintainable. The Supreme Court has held this deadline is absolute. You may still pursue a civil money recovery suit, but the criminal remedy — which is the stronger deterrent — is gone forever.

Civil suits: Time-barred by Limitation Act

If you file a civil suit after the limitation period (3 years for money, 12 years for property), the court will dismiss it as time-barred. The defendant simply has to plead limitation as a defence and your suit fails — regardless of the merits.

Consumer complaints: Forum may condone delay
